These terms are an agreement between you and:

2.What these terms cover
They cover every service and subscription we provide and bill for, across all of the websites, applications and products we operate — not only this one. They cover this website, any quote you accept from us, and any plan you subscribe to. Our Subscription Terms, Refund and Cancellation Policy and Privacy Policy form part of this agreement. Where a signed quote or proposal says something different, the quote wins for that project.
3.What we do
We design and build Android applications, websites, and the custom management systems that run behind them. We also host and maintain what we build, on the plans described on this site. We build for Android and the web. We do not build for iOS, and we will say so before you commit rather than after.
4.Quotes, and when a project starts
- A quote sets out the scope, the price, and roughly how long it will take. It is valid for 30 days unless it says otherwise.
- A project starts when you accept the quote in writing (email or WhatsApp is fine) and the deposit is paid.
- Anything not written in the quote is not in the scope. New requests are quoted separately before we build them — we will never add work and invoice you for it afterwards.
- Timelines assume you come back to us within a reasonable time. Long silences move the delivery date.
5.What we need from you
- Content — text, images, logos and anything else the build needs — supplied in a usable form.
- The right to use that content. If you send us a photo, we take it that you may use it and may let us publish it.
- One person who can make decisions and give approvals.
- Access to accounts we need (domain, hosting, Google, app store) or your co-operation in creating them.
6.Prices and payment
- All prices are in South African Rand (ZAR).
- VAT: not VAT-registered — our prices include no VAT and none is charged. Should we become VAT-registered, we will give 30 days' notice before VAT is added to any recurring fee.
- Once-off builds: a deposit is payable before work starts, and the balance on completion, as set out in the quote.
- Plans: billed monthly or annually in advance. See the Subscription Terms.
- Invoices are due within 7 days unless the invoice says otherwise.
- If an invoice is unpaid, we may pause work and suspend hosting. For subscriptions, what happens and when is set out in clause 9 of the Subscription Terms.
7.Who owns what
- Your content, your brand and your data stay yours at all times.
- On a once-off build, ownership of the delivered website or application transfers to you once it is paid for in full.
- On a monthly plan, you licence the system for as long as the plan runs. Where a plan says the website becomes yours after a minimum term, that promise stands even if you later cancel the system.
- We keep ownership of our own underlying tools, libraries and general know-how, and we may reuse them on other projects. We do not reuse your content, your data or your design.
- Third-party components stay under their own licences.
- Unless you ask us not to, we may name you as a client and show the work in our portfolio.
8.Hosting and third-party services
What we build runs on third-party infrastructure — hosting, databases, sign-in, analytics, email and payment providers. Those services have their own terms and their own uptime. We choose them carefully and we will tell you which ones your project uses, but we cannot guarantee a service we do not operate. Our Privacy Policy lists the providers that handle personal information on our behalf.
9.Your data, and your clients' data
Where we host a system for you, you are the responsible party for the personal information in it under POPIA, and we are your operator. We process that information only to run the system for you and on your instructions, we keep it confidential, and we secure it. If you cancel, you can export your data — we will not hold it hostage.
10.Warranty and support
- Once-off builds carry a 60-day warranty: anything that does not work as specified in the quote, we fix free of charge.
- The warranty covers defects. It does not cover new features, content changes, or breakage caused by someone else changing the code.
- On a plan, support and changes are included to the extent your plan says. Where a plan includes a monthly allowance of support time, work beyond that allowance is billed at the hourly rate in your quote, and we tell you before we exceed it.
- We are a small studio. We answer in business hours and we answer honestly about timing.
11.Acceptable use of this website
Use the site for genuine enquiries. Do not scrape it, attempt to break into it, or use it to send anything unlawful. We may block access if you do.
12.Limits on our liability
Nothing in these terms limits any right you have under the Consumer Protection Act 68 of 2008 or any other law that cannot be excluded. Subject to that: we are liable only for loss we actually cause, we are not liable for indirect or consequential loss such as lost profit or lost data where the loss is not our fault, and our total liability for any claim is limited to the amount you paid us for the work the claim relates to in the 12 months before it arose.
13.Ending a project
- Either of us may end a project in writing if the other is in serious breach and has not fixed it within 14 days of being asked to.
- If you end a project partway through, you pay for the work already done, and the deposit is not refunded once work has started.
- Plans are cancelled under the Subscription Terms, not this clause.
- When a project ends, we hand over what has been paid for.
14.Changes to these terms
We may update these terms. The version number and date at the top of the page change when we do. If a change materially affects an existing client, we give at least 30 days' notice by email before it takes effect.
15.Law, and how to complain
South African law governs this agreement, and the South African courts have jurisdiction. Come to us first — email info@pocket-architects.com and we will acknowledge within 2 business days and try to resolve it. You keep every right you have to take a complaint to the National Consumer Commission or a court.
