1.Who these terms are between
Between you (the subscriber) and Pocket Architects (Pty) Ltd. They sit alongside our Terms and Conditions, and they apply to every subscription we bill, whichever of our products or websites you subscribed through.
2.What we bill for
We collect our own service and subscription fees only — website hosting, maintenance and software subscriptions billed by us, to our own clients. We do not collect, hold, manage or distribute funds on behalf of third parties. If you buy goods or services from a website we built for someone else, that payment is between you and that business, under their terms, through their own payment facility. We are not a party to it.
3.The plans
We bill recurring fees across a number of plans and products — management systems, websites, hosting, care and support plans, and add-ons. Plans generally combine a monthly or annual fee with an optional once-off setup fee, and some include usage-based charges for work or volume beyond what the plan covers.
The price, inclusions, trial length and minimum term of your plan are set out in your quote and on that product's own pricing page. Those product details form part of this agreement. Where a product's published terms say something more specific than this document, the product's terms apply to that product. Everything in these Subscription Terms applies to all of them.
4.Free trial
Where a plan includes a free trial, no card is needed to start it, and nothing is charged during it. If you do not continue, the trial simply ends and you are charged nothing. Any minimum term starts after the trial, not during it. Your quote says whether your plan has a trial and how long it runs.
5.Minimum term
Some plans have a minimum term, which runs from the end of any free trial. Where one applies, your quote states it before you commit, and we will never apply a minimum term you were not told about. After the minimum term the plan continues month to month, and you may cancel at any time with 30 days' notice. Plans with no minimum term may be cancelled at any time on the same notice.
6.Billing
- Your billing date is the date of your first paid charge, and it stays the same for as long as you subscribe. Pay on the 6th and you are billed on the 6th of every month after that.
- Monthly plans are billed a month in advance. Annual plans are billed a year in advance, on the same date each year.
- Where a month has no such date — the 31st in February, for example — you are billed on the last day of that month, and the usual date resumes the following month.
- Payments are processed by PayFast. We do not see or store your card details.
- Any setup fee is charged once, on the first invoice.
- Usage-based charges — extra support hours, extra pages, message volume above your bundle — appear on the following month's invoice at the rate in your quote.
- All prices are in South African Rand.
- VAT: not VAT-registered — our prices include no VAT and none is charged.
7.Price changes
We give at least 30 days' notice by email before any price change. A change never applies inside a minimum term you have already started. If you do not accept a new price, you may cancel before it takes effect and pay nothing more.
8.Changing your plan
Upgrades take effect immediately and are charged pro rata for the rest of your current billing period. Downgrades take effect on your next billing date, so you keep what you have already paid for. A downgrade may not be used to escape a minimum term.
9.If a payment fails
- We email the address on your account the day the payment fails, and a notice appears in your admin area.
- You then have a grace period of 7 days, during which everything keeps working normally.
- We email you again before the grace period runs out, so the lock never comes as a surprise.
- If the payment is still outstanding after 7 days, the subscription ends and access is locked — your site and admin area stop working.
- Your data is not deleted when access is locked. We keep it for 90 days from that date, and you may ask us for an export of it at any point during those 90 days.
- After 90 days the data is permanently deleted. We will not be able to recover it after that.
- Paying the outstanding amount within those 90 days restores full access immediately, with your data intact — not at the next overnight run.
These notices go to the email address on your account, so please keep it current — it is how we reach you. We would always rather talk than cut anyone off. If money is tight, email us before the grace period runs out and we will work something out.
10.Cancelling
Cancel by emailing info@pocket-architects.com. Cancellation takes effect at the end of the period you have already paid for, subject to any minimum term and 30 days' notice — you are not cut off the day you cancel, and you are not billed again.
- Monthly plan billed on the 6th: cancel on the 12th and your access runs to the 6th of the following month.
- Annual plan billed on 6 March: cancel in July and your access runs to 6 March the next year.
Before your access ends we give you an export of your data. What happens to money already paid is set out in the Refund and Cancellation Policy.
11.What a plan does not promise
A plan gives you working software, hosting and our support. It does not promise you any number of clients, bookings or sales. We will tell you what the system can do before you pay for it, and we would rather lose the sale than oversell it.
12.Suspension for other reasons
We may suspend a plan if it is being used unlawfully, or in a way that puts other clients' systems at risk. We tell you why, and we give you a chance to fix it first unless the risk is immediate.
